1. The Court of Appeals of La Ceiba has not fulfilled its obligation to rule on the pre-trial detention of 8 Guapinol defenders illegally imprisoned since September 1, 2019. A thread about #LibertadParaGuapinol.

They have been internationally recognized for protecting water sources but the Honduran Public Ministry and the Judiciary punish them by favoring Los Pinares, a mining company with strong links to shareholders in the US, which does not have the consent of affected communities to operate. 4. En diciembre 2020, después de mas de año de espera para la audiencia de revisión de medidas, Jueza Zoé Guifarro en Tocoa denegó sustituir la medida de prisión preventiva para los defensores de Guapinol. Su fallo no tenia fundamento jurídico y lo apelamos.
4. In December 2020, after more than a year of waiting for a bail hearing, Judge Zoé Guifarro in Tocoa denied to the request to change the preventive detention measures for the Guapinol defenders. Her ruling had no legal basis and we appealed it.
5. La semana pasada, después de un retraso injustificada en Tocoa, la apelación fue trasladada a la Corte de Apelaciones de La Ceiba cuyos magistradxs son Irasema Guillén, Jimmy Chirinos, Rubenia Galeano, Garín Enoc Urquía.
5. Last week, after an unjustified delay at the Tocoa Court, the appeal was transferred to the Court of Appeals of La Ceiba whose magistrates are Irasema Guillén, Jimmy Chirinos, Rubenia Galeano, Garín Enoc Urquía.
6. A partir de lunes pasado, tenían tres días para revisar el caso y emitir su fallo. No lo hicieron. Mientras tanto, estuvimos con organizaciones aliadas en las calles de Tocoa, en el Palacio de Justicia de La Ceiba y frente del MP de Tegucigalpa exigiendo su libertad.
6. As of last Monday, they had three days to review the case and issue their ruling. They did not do so. In the meantime, we were with allied organizations in the streets of Tocoa, at the Palace of Justice in La Ceiba and in front of the Public Ministry in Tegucigalpa demanding their freedom.
7. También los defensores de Guapinol tuvieron una visita de solidaridad de la Convergencia Contra el Continuismo en el centro penal de Olanchito. Organizaciones nacionales e internacionales participaron en el día de acción virtual para exigir la libertad para Guapinol.
7. The Guapinol River defenders also received a solidarity visit from the Convergence Against Continuism at the Olanchito prison. National and international organizations participated in the virtual day of action to demand freedom for Guapinol.
8. Eurodiputadxs se pronunciaron a favor de la libertad para los defensores. También OACNUDHy Embajada del Reino Unido en Honduras velaba por el debido proceso. No es un caso complicado resolver. No existen y nunca han existido razones jurídicas para ordenar prisión preventiva.
8. Members of the European Parliament spoke in favor of freedom for the defenders. Also OHCHR and the UK Embassy in Honduras pressed to ensure due process.
This is not a complicated case to resolve. There are not, and never have been, legal reasons to order preventive detention.
9. Lxs magistradxs tienen insumos necesarios para entender obligaciones en cuanto la resolución y su deber de emitir fallo a favor de libertad de los defensores basado en fundamentos jurídicas. 2 herramientas jurídicas fueron presentadas por 13 organizaciones instando libertad.
9. The magistrates have the necessary information to understand their obligations regarding the resolution and their duty to issue a ruling in favor of the defenders' release based on legal grounds. 2 legal tools were presented by 13 organizations urging freedom.
10. Los 2 Amicus abordan obligaciones interamericanas sobre detención preventiva y estándares sobre defensores de DDHH y criminalización. Lxs expertxs revisaron rigurosamente el fallo de Zoé Guifarro y notan graves preocupaciones por la falta de motivo para mantener la medida.
10. The two Amicus briefs address Inter-American obligations on pre-trial detention and standards on human rights defenders and criminalization. The experts rigorously reviewed Zoé Guifarro's ruling and note serious concerns about the lack of grounds for upholding the measure.
11. También esta semana, denunciamos fiscales del MP, agentes de la Policía Nacional, Jueces y Magistrados por actos arbitrarios contra el derecho a asociación y de reunión pacifica de miembros del Comité Municipal en Defensa de los Bienes Comunes y Públicos de Tocoa.
11. Also this week, we denounced prosecutors of the Public Ministry, agents of the National Police, Judges and Magistrates for arbitrary acts against the right to association and peaceful assembly of members of the Municipal Committee in Defense of the Common and Public Goods of Tocoa.
12. ¡Exigimos el fin de la persecución contra personas defensoras de la tierra y el agua en Tocoa y en toda Honduras! ¡Seguimos luchando por el agua!

13. Magistradxs Guillén, Galeano, Urquía, Chirinos tienen obligación de cumplir con constitución, CPP y tratados internacionales en su fallo. Además, deben considerar fianza que fue ofrecida, un derecho constitucional. ¡Cesen el castigo de los defensores y dicten libertad ya!
13. Judges Guillén, Galeano, Urquía, Chirinos have an obligation to comply with the constitution, Criminal Procedural Code and international treaties in their ruling. In addition, they must consider the bond that was offered, a constitutional right. Stop punishing the defenders and release them now!
14. Protestar contra proyectos extractivas que afectan negativamente a tu vida y la de tu familia no es un delito. Decir "NO" a la minería y proteger el agua es una responsabilidad para el bien común.
